This paper introduces at the beginning the basic safety status and relatedlegislation of the mine in South Africa. The mining industry in South Africa is notsafe from the very start. A series of serious mine disasters have occurred in the early90’s. Later,“Lyon Committee” was appointed to research the safety and healthproblems in South Africa’s mining industry. After that, this committee suggested thegovernment to legislate a mining safety and health law, and revised it for two timesin1997and2008respectively. Based on this, the safety and health situation of themine in South Africa improves steadily. The thesis studies especially on the minesafety situation, laws, regulations and standards of South Africa.“Mine Health andSafety Act” of South Africa is a life to protect safety and health of miners as the coreconcept of law. Based on the “Mine Health and Safety Act” of South Africa,especially on the four aspects, that is, mine safety and health related subjects’ rightsand obligations, mine occupational health surveillance in South Africa, mine safetyand health representatives committees in South Africa, and mine safety and healthregulatory law in South Africa, which summarizes the experience that can be learnedfrom the mine safety and health in South Africa. Based on the importance of theminers’ safety and health, enhancing the legislation of the Mine Safety and Health,we should first propose to increase the mine health in the “Mine Safety Act”; makeclear the rights and obligations of the related subjects in the Act to promotingenterprises to fully fulfill security obligations; increase the mine safety and healthrepresentatives; increase the inspectors in Mine, the program of inspection in the Act,in order to achieve the purpose of comprehensively protection of miners’ safety andhealth.
