Research On Legal Issues Of Maritime Occupational Safety And Health Management In China

Occupational safety and health is related to physical and mental health of workers in all occupations.It also takes the possible impact on the surrounding communities and the integrated environment into account.And maritime working conditions,including physical labor demand,potential risk,loneliness,long working time,fixed working structure and high strength pressure and fatigue,makes maritime occupational safety and health face a more severe test.As one of the world's greatest power of shipping,the international status and the social influence of China are becoming more and more prominent,but the legislation and policy of maritime occupational safety and health are not complete.In order to ensure the safety and health of seafarers working on ships,sufficiently guarantee seafarers "decent work",this article studies mainly on maritime occupational safety and health management and research on the legal issues from legislation,management and enforcement agencies.It is divided into five chapters:the first chapter is the overview of maritime occupational safety and health.It makes clear the definition of the occupational safety and health,occupational safety and health management system,occupational safety and health management model.On the basis of it,this chapter gives the connotation of the maritime occupational safety and health and elaborates the particularity of maritime occupational safety and health from several aspects,in order to lay the foundation of the following research;The second chapter expounds the legal basis of maritime occupational safety and health management in China,including the feature of general occupational safety and health legislation,and performance way of international convention in marine field;The third chapter points out the legal problems of maritime occupational safety and health management from four aspects,respectively are the management system,the seafarers' health protection and accident prevention standards,multilateral cooperation mechanism,labor inspection;The fourth chapter clears China's current problems of the competent department by comparing enforcing departments at home and abroad;The fifth chapter puts forward suggestions for China's maritime occupational safety and health management,respectively from maritime occupational safety and health legislation,maritime occupational safety and health management system,relevant protection standards,the construction of multilateral cooperation,and administrative power to integrate various aspects of the competent authority.
