“People is the basic of a country, food is the basic of the people, security is thebasic of the food.” this is a phrase not only illustrates the importance of food, but alsoillustrates the importance of food safety. Food safety is related to people’s health andlife, related to the healthy development of China’s economy and political stability. Inrecent years, China’s food security chaos has happened frequently, for example,"Poison bean sprouts","Noxious duck blood in chili sauce","Stained bread" and"Dirty roast duck", the succession of food safety incidents not only cause us to panic,but also make food safety issues of small workshops re-surfaced and attracted theattention of the community. According to AQSIQ investigation, China’s food qualityand safety problems occurred mainly in processing of food production, particularly inthe small-scale food production and small workshops.“The food safety law of thePeople’s Republic of China” establishes China’s current food regulatory system whichis “Sub-regulation as the main approach, varieties regulation as an adjunct approach".But in this system, due to lack of supporting laws and regulations, supervision of foodproduction and processing small workshops and food vendors existing regulatoryresponsibilities unclear, repeated regulatory and other issues, regulatory blind spotsvery prominent. Recognizing the importance of food safety and the seriousness offood safety issues of small workshops, while our country should take measures toprotect all aspects of food safety, which establish and improve the legal system as ameans of legal regulation is the regulation of heavy in the weights.In the first instance, This paper introduces the concept of Food production andprocessing small workshops, including characteristics and status, and thus our foodproduction and processing small workshops were introduced preliminary. Thenfurther elaborated the theoretical foundation of small workshops of food safety lawsand regulations, legal support on the one hand, primarily the theoretical basis thateconomic law; institutional support on the other hand, including government failure, the distribution of benefits and other theories.In the next place, To the promulgationof "The food safety law of the People’s Republic of China" as a watershed, inchronological order, through detailed discussion of the change of China’s smallworkshop regulatory agencies, and the development and implementation of laws andregulations. In the course of legal regulation on the small workshops of food safetyproblems in has carried on the brief summary.Clear at this stage a small workshop offood safety problems,mainly including to small workshops lack of clear legalprovisions, the legal effect of the low level of existing laws and regulations, the lackof small workshops regulatory standards, regulatory system is flawed, the way of lawenforcement is not scientific, sports-style governance is more common. In view of thesmall workshops of food safety problems, from the system and mechanism, etc., thispaper analyses the causes underlying cause. Last but not the least, by summing up theexperience of foreign food production and processing small workshops legalregulation, provoke thinking small workshops on improving food safety issues oflegal regulation. Specifically including strengthening legislation to make food securitygovernance laws to small workshops; reform of the regulatory agencies, optimize thefood regulatory model to small workshops; increase efforts to support smallworkshops, changing regulatory approach; prevention-oriented, comprehensive foodsafety to prevent small workshops risk; improve their quality of small workshops foodproducers, strengthen social supervision. In this paper, the status of China’s smallworkshop on food safety issues as a starting point, analyzes the shortcomings of theexisting system of small workshops food safety laws, and put forward relevantimprovement suggestions, the hope is to contributed to build China’s food safety lawregulation.
