Food security is a major public security problem which draws great concern at home and abroad.In recent years,China's frequent food security affairs pose a serious threat on the health of consumers.Though the scale of food industry has expanded since the reform and open policy in China,and the lever of industrialization has been raised,there exist a good deal of small food workshops(hereinafter referred to as small food workshop).Among all the food security affairs,the problems of small food workshops are particularly acute.In response,related laws and regulations have been perfected and concrete rules about the small food workshops have been combed since the amendment of the Food Safety Law in 2015.Besides,detailed rules have been drawn up according to the Food Safety Law in provinces autonomous regions and municipality directly under the government.For example,how to strengthen the supervision of small food workshops has became a hot topic among scholars and the practice fields.In this paper,supervision of small food workshops has been analyzed in the view of the administrative law.Special research about the problems of small food workshops and pertinence countermeasures has been put forward in this paper as well.It contains the introduction of the background information and significance of the study,brief review and analyze of overseas advanced practices as well as related practices within the province.The whole paper can be divided into four parts.The first part,firstly,gives an explanation of the concepts of small food workshops,which combines the existing expressions.Then it analyzes the necessity and rationality of the supervision of small food workshops from the perspective of current situation,current research stratus,imbalance of market regulation,life security and service-oriented government.The second part combs the development process of the supervision system of the small food workshops,which includes the development situation of small food workshops stated in laws and regulations as well as other normalized document of law.It also generalizes the problems of small food workshops solved by the super vision system.The third part of the small food factory in Anhui Province,for example,the current small food factory supervision of the status quo and issues to study.Mainly include:the relevant regulatory legislation is not sound enough,manifested in the lack of food safety concept,the law and regulations system is complex,lack of coordination,the small workshop operators and practitioners of the legal responsibility of the provisions of light;food small workshop comprehensive strength is weak,hardware facilities and management level is low,the overall quality of employees is not high;food small workshop industry access is not standardized,the registration system threshold is low,is not conducive to food safety supervision;regulatory system is not smooth,look at the central and local regulatory system is still uncoordinated,the functional allocation is not reasonable;regulatory capacity is not high,the performance of a single means of management,grassroots regulatory authorities lack the necessary testing equipment and professionals;supervision and control mechanism is not perfect,social supervision of the environment and the lack of institutions,social supervision did not play its due role.The fourth part puts forward the countermeasures to promote the supervision of small-foodstuffs in China.It mainly includes:perfecting the legal system of supervision and supervision of small foodstuffs,absorbing the good experience all over the country,introducing the unified management rules of small food in the whole country as soon as possible,and combing the existing laws and regulations system in time to ensure that the relevant regulations do not conflict;increase the policy support,to help food small workshops to enhance the overall strength of the small workshops from the food to improve the system;to improve the small food entry threshold,in the small food industry to establish an administrative licensing system;in the regulatory system to continuously improve the functions of the Food Safety Committee,the integration of existing regulatory authorities;flexible use of a variety of regulatory means to improve the inspection and testing system to strengthen the construction of law enforcement team to enhance the regulatory capacity;establish and improve the social supervision system,effectively compensate for market failure and government supervision failure.
