Research On The Property Declaration System

Public servants’ property declaration system requires that a certain range ofnational public officers declare their property and their related persons’ property toappointed agencies according to the law rules and guarantees the right to know andthe power of supervision for people to make sure that civil servants to accept publicsupervision and balance. With the inherent public oversight, ruled by law and theimprovement of the government transparency function and other functions, theproperty declaration system has significant impact on the prevention of corruption andthe advancement of the modernization in the State governance system and governancecapability. Therefore, the research of this paper has some profound theoretical andgreat practice significance.This paper consists of five parts. Part one mainly presents the basic conceptionand content of the property declaration system. And the major characters andfunctions of the property declaration system are analyzed; In part two, it mainlyanalyzed the theory basement of the property declaration from which conclude publiclaw and international law; In part three, it mainly presents the current situation ofChinese declaration system by through analyzing some important legal documentsand the practice test of some provinces, and moreover it makes a conclusion with thereasons to the troubles of the implement of the declaration system. In part four, thisarticle summarize and compare the basic content of the property declaration systemsin other countries and regions such as the USA, the South Korea and Taiwan, in orderto get some inspiration for our system construction;In part five, it explores how to construct and improve the property declarationsystem of Public servants in China. The writer believes that the legislative path of“from the central government to the local government” should be selected and thethree basic principles of property declaration system which include good faith, generalpublic and responsibility correspond to legal punishment should be obeyed.Constructing and improving the property declaration system should enlarge thesubjects and objects of the property declaration system, promote the way of declaration, set up the supervision mechanisms of the accepted and supervisioninstitution and be strict to the legal penalty of violating the property declarationsystem. And establishing and improving the supporting systems of propertydeclaration system is the basement and prerequisites of the effectiveness of theproperty declaration system.
