The Research On Government Procurement Information Disclosure System

Government procurement is a kind of purchasing behavior that purchasingdemanders use public funds to purchase project, goods and services for the publicinterest or to meet the needs of the functions of administrative activities. Governmentprocurement information are the universally applicable files that stipulate governmentprocurement and the data and information reflect the status of the governmentprocurement activities. Government procurement information disclosure refers to thatentities which draft, obtain and have government procurement information disclosurethem by themselves or according to application accurately and timely. Due to thepublicity, the nature of government procurement should be a kind of administrativefact activities in the trend of advocating building a service-oriented government.Therefore, government procurement shall apply the Freedom of Information Act. Themajor legislation purpose of Freedom of Information is to protect the public’s right toknow. The amount of public funds is huge in the government procurement activities.The cases of black-box operation occur frequently. Accordingly, the governmentprocurement corruption cases appeared one after another, the public funds areembezzled. This is because the government procurement information not public orinadequate public. In this case, the public and the supplier’s right to know and otherrights didn’t get deserved protected, government procurement has failed to achieve itspurpose. This paper attempts to discuss the theory and practice of governmentprocurement information disclosure system from dual perspective of governmentprocurement and the freedom of information, in the hope of providing someenlightenment for the construction of government procurement information disclosuresystem. First of all, this paper attempt to clarify the theoretical basis of governmentprocurement information disclosure system; Secondly, analysis and points out China’spresent situation and problems of the government procurement information disclosuresystem; And then, try to do outside comparison for government procurementinformation disclosure system; Finally, combining with the comparison, try to put forward some suggestions for the construction of China’s government procurementinformation disclosure system.
