Government procurement information openness plays an important role on the following aspect,such as protecting legal interest of parties,increasing of utilization benefit of financial fund,maintaining public interest of nation and society,promotion for construction of clean politics.There is related principle of transparency in both PRC's Biding and Tendering Law and Government Procurement Law.Moreover,some subsequent laws bring more details to above principle,such as the enforcement regulations of the two laws above,Administrative measures for tendering and bidding for government procurement of goods and services,Measures for the administration of tender announcement and publication of public information.While there are some problems about it,which not only will obstacle the development of procurement system in our nation,but also can't satisfy the standard of transparency of World Trade Organization government procurement agreement(GPA),our countries are negotiating with.The main object of study of the dissertation is government procurement information openness.The writer teased the existing legislative regulation concerning on government procurement information openness,studied related regulations of GPA and America(as the party of GPA),after that offers some proposal to perfect government procurement information openness of our country.The dissertation is composed by five parts.The first part is the introduction,in which states the background of the study and the important impact of study,literature review,primary method of studying and structure of the dissertation.The second part is the overview of government procurement information.Firstly,connotation of government procurement information openness is elaborated.And then the thesis foundation of government procurement information is the citizen's right to know following.At last,government procurement information openness can decrease the corruption in the government procurement,enhance competition among providers,and contribute to all-process supervision on government procurement.The third part is about the requirement of government procurement information openness in GPA and of America.First of all,the requirement in principle for the parties of GPA is the principle of transparency--conduct government procurement in transparent,open ways.And the other section of this part is summarizing the subject of obligation,scope,specific requirement,channel,and period of the government procurement information openness.And then,organizing and concluding the regulations on American government procurement information openness.The forth part focuses on analyzing the current situation and describes the problems of and describes of our nation.Firstly,through the Biding and Tendering Law,the Government Procurement Law and their ancillary regulations and policies,the writer states regulations about subject of obligation,scope,specific requirement,channel,and period of the government procurement information openness.Secondly,the writer sets forth the situation of practice of information openness in our country.Lastly,pointing out the existing problems of government procurement information in our country,including different requirement towards government procurement information openness from between the Biding Law and the Government Procurement Law,publishing medias disunity,supervisor disunity,the content of procurement programs being uncompleted,and untimely openness of government procurement information classified as supervision and punishment.The fifth part is the improvement for the government information openness in our country.Stating the advices for improving government procurement information openness:firstly,unifying the regulations on government procurement information openness;secondly,unifying the publishing media and obligatory supervisor regulating violation of government procurement information;thirdly,enforcing the punishment of violating information openness regulations about information classified as procurement programs information;lastly,improving the punishment measure of violating information openness regulations about information classified as supervision and punishment information.The innovation of the article is mainly about:comparing and analyzing the government procurement information openness requirement of the GPA and America.
