Discuss On Perfecting Our Country’s Community Correction Legal System

Community correction is the execution opposite to prison correction, a concept of humanizedand socialized penalty execution method. It reflects the current penalty system is turning fromgovernment treated to society treated; the international penalty method is from severe to soft. AsUSA, Canada and UK, those Western developed countries have moved the community correctionto a relatively mature stage.Community correction is a new-born in China, to develop and perfect its legal system is oneof the important tasks of our current criminal justice legal system developing. With recent years’testing, we have accumulated some experience and also gained some legal and social effect.However, from the practical condition, our country’s community correction is still left behind, stillmany problem need to be solved.This paper briefly analyzes the concept and basic characteristics of community correction,also its generated resource and value pursuit. Based on these acknowledgement, this paperresearched our country’s current condition of community correction, compares our Beijing mode,Shanghai mode with other typical countries working mode, like Singapore’s government-leadingmode, America’s community self-governed mode, and Australia’s mix mode. There are lots ofcommon problems in the practice of community correction. The power of the executive subject istoo weak; they are flaws in the procedure; the legal supervision mechanism is not perfect; the legalsystem is not sound, etc. Meanwhile, according to these problems, come up with strategies, like tomake a Community Correction Law, complementary legal regulations, implemental details withlocal characteristics and complete our relative legal system, in order to promote the developmentand perfection of our community correction system.
