A Survey Report On A Prison’s Parole Status In Hebei Province

The Supreme Court implemented the new provisions of commutation and parole. Theynarrowed the range of commutation, and prolonged the lowest execution sentence of criminalsgiven the death penalty with reprieve and criminals of life imprisonment, whichlegally abolished the unreasonable rule of "Felony with More Reductions". But the newprovisions also weakened the restriction of the current prison reward andpunishment mechanism on the part of criminal reform performances, and increased someprisoners’ mental burden, and as a consequence, they affected their positive performances andincreased the prisons’ regulatory pressure.At the same time, the new regulations also established some beneficial rules to expandthe application of parole. For example, they made more specific rules for the essenceconditions of parole with no danger of re-offence in the "criminal lawamendment (eight)”, and they also relaxed the parole conditions on the old andsick prisoners, etc. As a prison police, the author hopes to seize the existing laws to reducethe concussion on the prisons made by the policy change, with the purpose of protecting thelegitimate rights of the prisoners and maintaining the supervision stabilization. Morehopefully, the author looks forward to improving the current commutation and parole laws,strengthening the existing community correction work abilities, promoting the expandingapplication of the parole system, and ultimately forming a reasonable mode of punishmentexecution which is "parole based and commutation supplementary".The author presents the parole works as a prison law enforcer. With the analysis of ajail’s problems in the work, he shows the prison’s dilemmas and frustrations in handling theparole cases in the judicial practice. To make it broadly, the author reveals thepresent situation and the deficiencies of parole in the implementation of our country’s penalty,and elaborates the importance of the promotion application of parole. Meanwhile, the authorputs forward the specific measures to improve the parole system. All in all, the author isinclined to solve the problems facing the current parole work, on the condition that we canhelp the criminals return to society as soon as possible within the reasonable laws.
