Improvement Of Medical Care System On Guarantee

The medical treatment on parole system is an important institution in the execution of punishment of our country,which is a criminal policy showing judicial civilization and indicating the protection of the criminals' rights of life and health from the party and the government.However,with the further deepening of the opening of the prison affairs,the systems are constantly improving,such as commutation of sentence,conditional release and medical parole.It has been found that some criminals made use of the defects of laws and regulations,and conducted commutation of sentence,conditional release and medical parole against regulations,which escaped the regulations.The Central Committee of the Communist of China attached great importance to this phenomenon,and on the central political and legal work conference in 2014,the General Secretary Xi Jinping criticized severely the violation of discipline of commutation of sentence,conditional release and medical parole.Subsequently,a special action was launched to renovate the breaking of laws on this matter.During this procedure,at least 7 medical parole criminals who had been cadre of section rank were put back into prison again.But in the specific process of judicial practice,owing to the defects of the current institution of medical parole,the illegally medical parole has became a tool for some lawless elements to escape the punishment.According to the research findings of this paper on the institution of medical parole of our country,there are several aspects listed below in which the problems lie:The first,we found some defects in the relevant legal basis.The second,the problems in approval and appraisal were also noticed.The third,there are also troubles in supervision.The author combines the research on medical parole with specific working practice,and comes to a conclusion that this problem can be solved through three ways of improving the laws,strict implementation of institution and building a thorough supervision system.In addition,in the light of the problems of medical security and social support in medical parole,a further discussion in needed on the fields of social medical security and economic rescue.It's hoped that through this research,some improving strategies can be offered to solved the problems in the work of medical parole in our country,to efficiently maintain the judicial justice of our country and to guarantee the rights of life and health of the criminals.
