Research On The Rage And Order Of The Legal Heirs

The Inheritance Law is implemented in October1,1985.However Our country’ssocial economy, culture, life attitude, property status, marriage and family relationshave changed too much in this28years.Obviously, the Inheritance Law whichincludes37provisions have been unable to adapt to our social reality. Accordingly,theauthor analyzes some limitations in Inheritance Law,especially the problems of therange and order of the legal heirs,and puts forward opinions on the improvement.The thesis consists of five chapters,about30,000words in the thesis.Chapter1is the introduction. Introduce the starting point of the article,hoping beadvantageous to the improvement of the law.Chapter2is a generalization part. Firstly,introduce the definition and charactersof the range and order of the heirs.Then introduce the factors which establish therange and order of the heirs. Thirdly,we can conclude: Inheritance Law isunreasonable,it cannot reflect the social reality,we confront a significant task that weneed improve the provisions in Inheritance Law.Chapter3is a comparison on the range and order of the legal heirs of maincountries in the world.The first section compares the range of the legal heirs,thesecond section compares the order of the legal heirs.Aiming to using the foreignlegislation experience for reference to improve the provisions.Chapter4is the drawbacks of the range and order of our Inheritance Law.Theauthor discusses this from seven aspects.For example,the spouse inheritance rightneed to be protected more;the inheritance of children and so on.Chapter5is the assumption of how to reform the range and order of legalheirs.This chapter according to chapter4which includes the drawbacks of the rangeand order to put forward the author’s opinions.
