Research On The Scope And Sequence Of Legal Heirs In China

30 years ago,"Inheritance Law" promulgated in China,after 30 years with the change of China’s social economy and culture,marriage and family relations,family values and other factors,the "Inheritance Law" has been unable to fully meet the needs of society,in many ways out of touch with the material and cultural life and our people’s concept of marriage and family.This article is based on the "Inheritance Law"faced by these difficulties,the scope and sequence of the legal heirs of the system is studied,and some suggestions are put forward.First,this paper introduces two cases of the case and the relevant controversy caused by the case,the facts of the case,the controversy to make comments and questions.Secondly,this paper introduces the basic theoretical issues of the scope and sequence of legal heirs.The third part and the fourth part respectively on the problems related to the scope and order of legal successors,through the investigation of the domestic and foreign theory and practice,the provisions of the "law of succession"return to the legal heir range and order system,through the combination of the two cases,pointed out that China’s current lack of "Inheritance Law" the relevant statutory succession the scope and order aspects,put forward to modify the existing system of the legal heir.
