"Rights" derived from the inherent nature of human, it’s the core concept ofLiberal Political and Law, its meaning is that "personal autonomy" is legitimate. Forthe pursuit of rights, human beings have never ceased. With the elevation of humanmaterial and cultural living standards, people’s own awareness of their rights has alsobeen enhanced,"Rights" has become an important symbol to measure the civilizationof modern society.On the basis of critically inherited the previous rights thought andthe position of historical materialism, Marx through in-depth study of human lifepractice and production practices and participate in the process of revolutionarypractice personally,he formed unique Marx’s rights perspective.This article mainly research and analyze the relevant thought of Marx’s view onrights and its contemporary value from the five aspects.The first chapter aims to sort out the theoretical origin, the forming process ofMarx’s view on rights, points out that Marx’s view on rights is characterized byhistorical, practical and social. At the same time clear Marx’s basic ideas about rightsand its power generation and development of ideas.The second chapter mainly elaborates the subversion of Marx to the idealismfoundation of modern view on rights. In the early, under the influence of Kant andHegel who are the representative of the German classical philosophy of law thinkersformatted Marx’s early rationalism rights perspective. However, after going deep intosocial life, Marx encountered the difficulty of material interests; namely, it is the lawof "distressed doubt". After recognizing the idealism foundation of modern view onrights, Marx subverted the idealism foundation of modern view on rights by theprinciple of "survival practice". The third chapter mainly discusses Marx’s dialectical analysis of the bourgeoisrights. on the one hand, Marx affirmed the historical progress of bourgeois rights:overthrow the religious divine right and feudal hierarchy and privilege, eliminateobstacles of the development of the capitalist mode of production, promote thedevelopment of the capitalism political civilization; On the other hand, he revealedthat Bourgeois rights itself has insurmountable limitations and hypocrisy, And in theterms of political economics, he criticized bourgeois Rights.The fourth chapter is on the basis of the criticism of the bourgeois rights, Marxput forward from the "historical rights" to "real rights”. Marx made the basic rules topolitical emancipation and human emancipation; he analyzed the civil society and the"right" of history, the socialization of human beings and "real rights" two importantquestions. Marx proposed the essence of human emancipation, targets and realizationand pointed out that to achieve "everyone’s free and comprehensive development" isthe ultimate goal of human emancipation.The fifth chapter is based on the analysis and discussion of the article, combiningthe actual situation of contemporary China to unearth the contemporary value ofMarx’s view on rights. In the world, as a fairly representative of the socialist countries,China is bound to guide by Marxist theory. Therefore, for the study of Marx’s rightsperspective have the important guiding significance to contemporary Chinese socialistdemocratic politics construction and socialist economic construction. Marx’s rightsperspective inspired us to shape the citizens by rights, cultivate awareness of the rightsof citizens and safeguard the democratic by rights to promote the development ofsocialist democratic politics. At the same time, Marx believed that we must exertnational autonomy to build ownership of market entities, equality and free marketeconomy. Safeguarding the mutual promotion of the rights and powers and promotingthe development of market economy to achieve fairness and justice.
