A Civil Dispute Settlement Mechanism Of Court Multivariate Analysis

Since2010, the Quanzhou court system of first instance civil cases acceptedshowed a rising trend year by year, and the increase in more than20%. In this case,the court system to reduce the working pressure, achieve the node, profits from thedomestic and foreign judicial ADR results, establish and perfect the multi linkagemechanism to resolve disputes. In this paper, based on the practice of the courts ofQuanzhou, through the study of judicial ADR, thinks that in our country, perfectinglegislation, expand the field of judicial ADR and increasing method is very necessary.On this basis, combined with the practice of Quanzhou court, to our country thediversification of the dispute settlement mechanism is proposed to improve thereasonable and feasible suggestions, hope to resolve the dispute in China can be morestandardized, more to adapt to the rapid development of economy and society.The first chapter of this paper, from the basic concept of judicial ADR definition,introduced a system of judicial ADR related concepts and their characteristics,function, main types.The second chapter, has carried on the introduction to the USA, UK, Germany,Japan, the judicial ADR system, and analyzes their respective characteristics andenlightenment.The third chapter, operation and focuses on introducing the multivariateQuanzhou court system of dispute resolution mechanism, and analyzed from multiangle, discussed our country to the diversification of the dispute settlementmechanism exist deficiencies.The fourth chapter, discuss the feasibility of proposals to improve China’sdispute settlement mechanism from the legislative, judicial, social system perspective.
