The Research Of The Legal System Of Food Recall In China

The process of science and technology leads to the development of food industryand people’s pursuit of quality of life. The complication of food process furthertrigger food safety risks and it goes contrary to our wishes. Food safety is closelyrelated to people’s health and life, therefore, as a guarantee of food safety, the foodrecall system is increasingly significant. On the one hand, in China, the theory aboutfood recall system started late so that we still need to spend more time and energy ondesigning this system according to our reality. On the other hand, in practice, theincidents of food safety are exposed constantly, which indicates there are problems inour food recall system, such as imperfect legislation, imperfect process, unreasonableillegal cost, inadequate supervision. So the improvement of the food recall system isimminent.This paper is divided into four parts.The first chapter starts with elaborating the concept and characteristics of thefood recall system. And it illuminates the basis and practical significance of thissystem, which reflects the irreplaceable value of the food recall system.The second chapter mainly discusses the defects of food recall system in ourcountry and it points out the problem of initiating the procedure and implementationeffect. According to the analysis of the reason, it concludes that the illegal cost,specific process, liability system and supervisory system of the food recall system areimperfect. The third chapter makes comparison of the food recall system among differentforeign countries on the basis of knowing what their regulations are. It tries to absorbbeneficial ingredients by studying their design of cost, process, liability, supervisionand supporting system in order to provide guidance for our improvement.The fourth chapter is about suggestions. On the basis of analyzing the reasonwhy the food recall system did not work well and studying food recall system inforeign countries, the author puts forward some pertinent suggestions. Punishmentand incentives are both considered in the design of cost, which indicates that theeconomic law tends to guide the behavior of people. Degrading qualification andcredit can also be added to liabilities of economic law in order to raise the illegal costand reduce recall costs in all respects. In addition, it is better to make practicalprocess in each stage of food recall to guide recalls and combine the system ofliability and supervision with supporting system to make sure the food recall systemplays proper role.
