The Predicament And Innovation Of Governance About Street Vendors’ Road Occupation Operation In China

That street vendors occupy the road to run their stalls and booths has always been apredicament for the city governance. With the development of the economic society and theurbanization, the street vendors fill in the cities unavoidably. As more and more street vendorsflow into the cities, the social problems they brought also became sophisticated. Thecontradiction between the street vendors and law enforcement officers of urbancomprehensive management also became more and fierce so as to influence the social safety.All the problems above have attracted widespread attention from the society and the citygovernments.This dissertation is divided into five parts. The first part of the dissertation is introductionincluding the topic background, selected topic basis, a brief summary of the research on streetvendors’ road occupation governance, the theoretic and practical significance and etc. Thesecond part introduces the relative concept of road occupation operation. Besides, theprinciple of proportionality is adopted so as to analyze the situation of the street vendors andthe law enforcement officers of urban comprehensive management and the writer pointed outthat the principle of proportionality should be applied between the street vendors and the lawenforcement officers of urban comprehensive management. Based on the relative theory anddefinition of street vendors’ occupation operation, the causes of this phenomenon are analyzedand the causes are the changes of social structure, less perfect social security system and theneed of market. The third part mainly introduces the existing circumstance of street vendors’governance in our country and the characteristics of the vendors’ road occupation operationincluding the characteristics of the human components, activities and distribution of streetvendors. The current three governance modes and the problems about the governance willalso be introduced. The forth part introduces the experience of street vendors’ managementfrom other countries and regions such as the America, South Korea, Singapore and Taiwan.The last part gives the consideration and countermeasures to the predicament for citygovernance and points out that only changing the current governance idea and strengtheningthe construction of law enforcement team, the governance can become more and morehumanized and standardized. This dissertation focus on the research through the methods ofliterature analysis and comparative analysis so as to put forward the thoughts of my own andhope that while governing the phenomenon of street vendors’ occupation operation, the government should give consideration to the interest of all aspects and make the distributionof interests more reasonable.
