Accelerated pace of urbanization and substantial increase of urban populationmaking the city in an overload state; China is a country with a large population butfewer resources, combined with the poor ability of relevant departments, there hasbeen great confusion and imbalance in real estate market; There are a large number ofreal estate speculators for personal gain in the chaos of the real estate market, causingprices to grow in rising trend and basic housing needs in an unattainable state. Inrecent years, the governments gradually introduce lots of Huimin policies likelow-rent housing, economic affordable housing, Capped-price housing and other basichousing security system in accordance with actual housing situation and the needs ofpeople of the country, However, due to the lag and limitations of these affordablehousing system resulting in a considerable part of the population blocked outside theprotection threshold. Under the currently proposed target of vigorously advocate forConcerning and improving people’s livelihood, and in response to the call of "Shelterfor all", in order to solve the housing problems of this part of the population, ourcountry put forward the public rental housing system.The ideas of this article are as follows:Chapter one, first Combing and elaborating of the proposed background ofpublic rental system and the development of public rental system in recent years, tolay a solid foundation for the following parts. This article analyzes the existinglegislation status quo from the combination of existing legislative texts and practiceperspective.Chapter two, Public rental system contains the basic administrative philosophy.Demonstrating its significance of public rental system from the dimension ofadministrative supply and human rights, the essence of public rental system is asacred duty and obligation of the country to protect the fundamental rights of thepeople.Chapter three, based on the more characteristic public rental legislative text ofthe provinces and cities, plus spot investigation and research of the Chongqing publicrental housing, determining many defects and problems currently existing in thepublic rental system. The first level is the common problem described and analyzed from the legislative text of the various provinces and cities, The second level is basedon spot investigation of public rental housing found that the public rental systemproblems that exist in the actual operation.Chapter four, this article promotes countermeasures to improve the public rentalsystem from the perspective of domestic and foreign. The first level is based on theproblems and shortcomings of the existing domestic public rental, putting forwardCountermeasures for the development of sound laws and regulations, expanding thescope of protection, broadening the residency restrictions, breaking through in thestructure of building housing. The second level is discussed from the successfulexperience of the extraterritorial, Due to the late start of public rental system, still inits infancy, and all aspects of immature phenomenon, foreign countries such as Britainand the United States, Singapore, Hong Kong and other places, have formed perfectfeatures and run mature policy, Therefore, we need to learn from the successfulexperience of foreign countries to improve ourselves, to accelerate the constructionand improvement of public rental system as soon as possible and work out a completeset of practical and effective measures to protect the rights and interests of people’sbasic housing system.Chapter five, this article makes some bold assumptions based on this system’sdefects, and proposes innovative mechanisms, Such as the establishment of apermanent rental system and the system for a Specific period system, integration ofcommercial housing and public rental housing, the rational utilization of vacanthousing, and innovative mechanisms of sound the online management mechanism andthe establishment of specialized institutions, in order to promote the furtherimprovement of the public rental housing system, enabling more efforts to safeguardthe housing interests of this part of the population, so as to realize the basic livelihoodof the disadvantaged groups to be protected.Finally, the conclusion and prospects of China’s housing security system.Housing is a basic material needs and national human rights that should to beprotected, however, the housing problem is difficult to be solved, which shows agrowing trend with the improvement of the modernization level. Government is theimplementer to protect the basic rights of the People. Therefore, the governmentshould earnestly safeguard the basic rights of the people’s basic rights under theguidelines of the party and the country’s policies and the requirements ofadministrative Payment. I believe that under the government-led and the joint efforts of the community, we will gradually achieve the ideal target----"Everyone shall havethe residence".
