On The Protection Of Equality Right Of AIDS Patients

"AIDS" is a transmission which human with current medical level can’t cure. Discrimination against AIDS patients in the society can be found everywhere. The purpose of this paper is to prevent AIDS patients from all kinds of unequal treatment and to get equal opportunities of development. In order to analyze the problem deeply, the article is divided into the following several parts:First of all, I list several typical cases to reveal the present situation; Then, I will analyze the true meaning of "equality" from the perspective of legal, pointing out that equality has two perspectives, which are form equality and substantive equality. We should combine them together;Thirdly, I will analyze the specific meaning of the right of AIDS patient’s equality, such as the right of working, the right of seeing doctor, the right of buying a commercial insurance, the right of going to school, the right of freedom and the right of having privacy; Finally, I draw the conclusion that in order to truly protect the equal right of AIDS patients, we must use legal means:Firstly, we must establish the system of the review of constitutionality to make the constitution truly play its role; Secondly, we must establish a perfect legal system, make the constitution more effective and issue a special law about the protection of AIDS patient’s equality.
