Bribery and giving bribery both must be considered.Specifically, the object of a crime should be considered the probity of foreign public officials the performance of duties and the integrity of the international fair market order; criminal subject can not be ignored when defined as having a body of bribery of foreign public identity as a natural person and transnational company; people should pay attention to the bribe and the way of bribe offering.Considering the need of to fulfilling obligations of the relevant international conventions and protecting their international trade and foreign investment interests, countries have adopted different way to improve their domestic legislation, to achieve docking with the relevant international treaties in three way, including constitutingsingle legislative of Anti-abroad bribery, single anti-corruption legislation and vising the relevant aticle of criminal lawIn2011, the " Criminal Law Amendment (eight)"was promulgated.bribery of foreign public officials and officials of public international organizations crime was regulated in Article164of new Criminal Law.It reflects that China recongenizes great importance of combating transnational bribery.But the current criminal regulation of bribery foreign public officials and officials of public international organizations crime is not enough.
