On Rights Protection Of Foreign Workers Under Chinese Legal System

Under the background of economy globalization,the frequent movement of Chinese and foreign labor force makes our country’s imperfect management face the serious pressure. As China has a market with great potentials,whether the labor force have an employment permit or are illegal,they are both pouring into China for money. The number of foreign labor force has increased fast which is combined with inadequate nation law system has caused a series of problems like the infringement between foreign workers and employers, employment discrimination, social insurance, work injury payment and other labor contentious issues arise.Facing this kind of background, this thesis has done the research on the management on foreign labor force and the nation law system to define the foreign labor force as well as analyze the inadequacy of foreign labor force now working in China.Last but not least, this thesis analyzes the cases on the management on laws of foreign force labor in typical countries which will combine with the national conditions to build a reasonable and efficient law system in order to protect the foreign labor force.This thesis is divided into fore parts:First part:Overview of question about foreign laborer rights and interests protection law.This part works on the definition of the foreign force labor,analyzing some particular points of the foreign force labor in China,the way to make an analysis on foreign force labor is the subject of this thesis;This part also for foreign laborers rights and interests, the essay discusses the necessity of legal protection, analysis of the progress and problems of legal protection in our country at presentSecond part:The inadequacy of China’s law system on the protection of foreign force labor.This part mainly concludes China’s law system on the protection of foreign force labor,trying to analyze the inadequacy of the law system just for consideration.Third part:Typical foreign countries an introduction to the legal protection system of foreign workers and enlightenment.This part analyzes the complete results on the management of foreign labor force in some developed countries like USA and EU,which and make the reference in the following passage to complete China’s law system and management system.Fourth part:Some suggestions in improving the law system of the protection of the foreign labor force, which is the main point of this thesis.The former four parts are to pave the way for this important part.When we find out the problems so that wo can find solutions.Firstly, i want to make an analysis on the extraterritorial effect of the labor law.I think some rules of the labor law should have been extraterritorial in some special conditions,government can’t ignore the extraterritorial effect of foreign labor law.Secondly,we can combine the fact of our country with foreign countries to make some suggestions on the protection of the labor law system in order to make the practice perfect.
