Study On The Supervision Dilemma Of The Grassroots Labor Department In The Protection Of The Rights And Interests Of Migrant Workers

Farmers’ work is the main force in China’s urbanization transformation,but in the long-term social labor process has not obtained due social status and psychological identity,and even its legitimate rights and interests have been repeatedly infringed.On the surface,it is the dual social structure of urban and rural division caused by household registration system.In essence,it is the imperfection of labor laws and regulations,the lax enforcement of labor security supervision departments,and the failure to effectively implement the policies,which leads to difficulties in safeguarding the rights of migrant workers whose rights and interests are infringed,and the illegal acts can not be corrected,thus forming a vicious circle,which leads to the difficulty of effectively stopping the illegal acts.Academic circles have also carried out a lot of research on this issue and achieved fruitful results.However,because the main body of enterprise employment is becoming more and more complicated,the "Internet +" employment model is really rising,the protection of migrant workers’ rights and interests is constantly upgrading,and the existing research results mainly focus on migrant workers.On the basis of this,the author takes the supervision situation of the labor supervision department of J city R district as the starting point,and takes the theory of social justice and the theory of labor process as the theoretical basis.First,the literature research method is used to sort out the rights and interests of migrant workers,to form a holistic understanding of the research objects and to form research problems,and then to understand the difficulties encountered by grass-roots inspectors in law enforcement practice through in-depth interviews.Finally,the typical cases are systematically sorted out and analyzed.Through analyzing the predicament of labor supervision in J city R district,the author puts forward some suggestions for improvement from the internal and external aspects of labor supervision department.At the internal level,mainly by perfecting the rules and regulations of labor security supervision,we should first raise the legislative rank of labor supervision laws and regulations,strengthen and perfect the work of "linking up the two laws ",and enhance the supervisory status of labor security supervision departments.Change the management mode of labor supervision organization.Secondly,we should improve the law enforcement ability of the labor department,perfect the system of labor security supervision organization,strengthen the construction of labor security supervision team,and perfect the labor security supervision system.At the external level,we must first give full play to the role of private enterprise trade unions.Secondly,we can establish the anonymous scoring mechanism of labor and employment in enterprises,and take matching rewards and punishments according to different grades.Finally,enhance the awareness of migrant workers rights,so that violations are stopped in time.
