Study On The Cashing No-fault Congenital Mental Retardation Persons’Social Security Rights

According to China’s second national sample survey of persons with disabilities Bulletin in2006, it shows that as of April1, there are554million people with intellectual disabilities in china, accounting for6.68%of the total number of persons with disabilities; there are about430million people accompanied with intellectual disabilities in multiple disabilities. The overall security situation of mentally retarded persons is relatively poor, and there are still many problems. These problems will not only affect people with intellectual disabilities’ and their families’ live and work, but also will affect the comprehensive, coordinated and sustainable development and social harmony and stability of the cause of the disabled.From the perspective of social risk cashing, this research study to cash the social security rights of no-fault congenital mental retardation persons. The purpose is to establish a no-fault congenital mental retardation persons’ identification system, and the social security rights system. Meanwhile, the study has attempted to establish a cashing system structure of no-fault congenital mental retardation persons’ social security rights, and demonstrated its operating conditions.The main conclusions of this study are as follows:For no-fault congenital mental retardation persons, social risk-based standard is an important reflection in its screening identification system. Drawing on the basis of the existing measurement standards, this study combined with clinical standards and social risk-based standards, as a system of no-fault congenital mental retardation persons’standards.For viable system of social security rights with no-fault congenital mental retardation persons, the measurement standard is the time standard and hourly wage standard. Time standard is based on the average time which no-fault congenital mental retardation persons need to take care of; hourly wage standard is based on the average hourly wage of primary medical caregivers.According to the degree of mental retardation impact on daily living, the cashing grade level standards of no-fault congenital mental retardation persons are divided into four grades. In cashing system architecture, the cashing standard is the product of mental retardation time and hourly wage care. For the first cashing standard, the standard value of time interval [2.091,3.917] hours; for the second cashing standard, the standard value of time interval [1.925,3.011] hours; for the third cashing standard, the standard value of time interval [1.103,1.870] hours; for the forth cashing standard, the standard value of time interval [0.412,1.009] hours. In cashing system, four levels of hourly wage standard value of16.138or17.796Yuan.The scope of cashing system is limited to no-fault congenital mental retardation persons. Meanwhile, the cashing system has higher requirements on the professionalism and determination techniques and methods personnel. It must meet certain conditions to use the cashing system, including human conditions, material conditions, financial conditions, institutional conditions and information conditions. No-fault congenital mental retarded persons’ social security cashing system can protect the rights of no-fault congenital mental retardation persons to live with a human dignity way, and promote the healthy and sustainable development of society runs, without a doubt, it also has a positive effect on social development and human development.
