Research On The Legislation Of Chinese Emergency Volunteer Service

Volunteer service is social service that provided by people not for the purpose of getting paid. It is based on free will rather than on personal obligation or liability. Modern volunteer service has been extended to the field of emergency response, that is emergency volunteer service. Emergency volunteer service is the service that provided by volunteers and their organizations in the stages of emergency prevention, preparedness, emergency relief and reconstruction. Emergency volunteer service has played an extremely important role in the process of response to various kinds of major emergencies in recent years. But it is also exposed many problems, such as not to be included in the emergency management system, and no special laws to protect it and so on.So far, on the volunteer service legislation, Chinese mainland has issued36local volunteer service ordinances. National volunteer service ordinance has been included in the legislative work program of the State Council, and the construction of emergency management system in China is carried out in full swing. In this context, it is very useful and meaningful whether in theoretical or practical level to research emergency volunteer service, and put it into the national volunteer service ordinance.By giving a clear concept of emergency volunteer service and introducing the legislative experiences in other countries and regions, this paper has analyzed how to seize the opportunity of drawing up the national volunteer service ordinance to establish the legal guarantee system of emergency volunteer service. In addition to the introduction and conclusion, this paper is divided into3sections to explain in detail:The first part first analyses the concepts of emergency and volunteer service, then leads to the concept of emergency volunteer service. And then analyses its differences from normal volunteer service, and finally introduces the development course of emergency volunteer service of domestic and foreign.Furthermore,the second part introduces the legislative status of emergency volunteer service in America, Germany and Chinese Taiwan Province. And sums up the experiences which can be used by us.At the last,the third part first analyses the legislative achievements and shortcomings of our existing local volunteer service ordinances. Then suggests to establish a special chapter "Emergency volunteer service" in future National Volunteer Service Ordinance,which includes the special principles, coordination mechanisms and other contents related with emergency volunteer service.
