On Studying Of Political Parties And Constitutional System From The Perspective Of Britain, America，France And Germany

In the trend of economic globalization and political democratization，thestudy on the political parties and the constitutional system has became anobjective tendency.lt has became the common sense to in favor of the rule of lawnot of man, as far as the level of political value is concerned.This paper tookBritain, America, France and Germany as examples for introducing their differentpolitical parties and constitutional system. It included the Cabinetry System ofBritain，the Decentralization System of America and the Mixed System of Franceand Germany.Compared with the summary of the constitutional system inOccident countries, meanwhile, it was concluded that different countries havevarious constitutional systems based on unlike backgrounds that include politics,economics, cultures and religions. The conclusion has further guidingsignificance in the development of our political parties and constitutional system.At the first，this paper introduced the basic theory of political parties andconstitutional system. Then, this paper took Britain, America, France andGermany as examples. It tried to conduct in-depth comparative analysis on thechanges of the role that political parties played in constitutional status and whatthose changes caused to the diversity of constitutional system.At the last, it wasconcluded that we have made substantial progress in the study on the constructionof our constitutional system, though，our study on CCP’s governing ideas,governing system and ruling by law has not been perspective. Although，our constitutional system based on ruling by law under the leadership of CCP needsfurther improvement, the constitutional system with Chinese characteristics fittedall Chinese’s will and China’s national situation. From the perspective ofconstitutional democracy, this paper gave the explanation by the comparativeanalysis of political parties and constitutional systems chosen by Chinese andWestern.Besides, this paper combed and discussed on the changes of the role thatpolitical parties played in constitutional status and what those changes caused tothe diversity of constitutional system，then it introduced the political parties’influences on the choice of constitutional system, the constitutional significanceof political parties and political party system was an important part ofconstitutional system.On this basis, this paper gave the comparative analysis ofdifferent society background and the diversity of political parties hold the powerand its practice in different counties, hereby, it got the conclusion that thediversity political civilization was an important part in the world humancivilization.The political parties of above four countries had advantage in the constructionof constitutional system theory，so their advantage had some degree of guidingsigniifcance to our construction of political parties and constitutionalsystem.However, we should discard the dross and select the essence based onfully demonstrated, and chose a political parties and constitutional system regimewith Chinese characteristics and suitable for China.Finally, we chose theconstitutional regime based on ruling by law under the leadership of CCP. CCP chose the regime in diversity political civilization according to China’s situationand political practice for the purpose of constitutional system and rule of law. Itwas under the leadership of CCP that we had the possibility of establish theconstitutional regime with Chinese characteristics.
