Research About Philosophy Thought Of Law In "Monglia-oirat Code"

Mongolian philosophy ideology has its unique form of expression,which is shining the nation’s rich philosophy ideology in literary, religion,law, medicine, oral literature and proverbs.“Mongolia-OiratCode”(“Oirat Code”) is one of important literatures of Mongolian lawand history, which contain precious philosophy thought of law.Philosophy thought of law is an important part of Mongolian philosophyideology which has not been extensively studied yet. Therefore, based onthe results of previous studies, this paper research “Oirat law” from thephilosophy thought of law perspective that is the Marxist philosophy oflaw economic and political analysis methods. It mainly analyze from thethree aspects such as:background and guiding ideology, summary ofphilosophy of law and the code’s philosophy thought of law,characteristics and nature and so on.The first part, it analyzed the formulation background of “Oirat law”from the economic roots and the each classes and their relationship. Thesecond, it explain the concept, characteristic, object of study, basic issues,content and system, which laid the foundation for subsequent analysis.Then it mainly generalize from these three aspects which are thephilosophy thought of law of “jointly develop law, achieve reunificationby law”,“govern by combining legal and ethical” and “ecologicalprotection” and also systematically disserted. This part is the difficulty and emphasis of the paper. The third, the paper generalize the philosophythought of law characteristic and essence of “Oirat law”,based on theanalysis of philosophy thought of law of “Oirat law”.
