Recently, one indisputable fact is that there is a widespread concern on the reformof the judicial system. A complete set of judicial system is the key to building oursocialist country under the rule of law. Scientific legislation, rigorously enforce law,judicial justice and citizen abiding by law is the core of the country under the rule oflaw. The measures reforming the judicial system must be further taken to build Chinaunder the rule of law and to ensure to exercise adjudicative and procuratorial powersindependently and impartially by law, establishing the operation mechanism ofjudicial power is to embodying the core value of fair and justice. The best rule of lawall requires people abide by and apply, in the course of the trial judge, a good judicialdecisions are from judge applying the law justly and effectively, and the judge justicerequires judges’ internal standards to guide, which is the judicial conscience.The judge’s own quality is the foundation of the thesis, from the legal perspective,to reveal the judges can’t exercise the judicial trial power without under the guidanceof judicial conscience. This thesis begins to introduced the concept of the judicialconscience from the understanding of the meaning of ethics and conscience, to setforth the profound meaning and interpretation of the judicial conscience and itsimportant role in the construction of rule of law, at the same time, carefully analyzingthe social phenomenon and illustrating with example are to reveal the lack of thejudicial conscience problems during the judicial activities and appeal to university topay attention to the judicial ethics for students of legal professional education andcourt to attach importance to judge’s judicial conscience, devote to forming thejudicial conscience and establishing security system. Gradually, a common valueorientation comes into being in judge’s group, and they reach a consensus onapplication of law and the legal thinking, and gradually realize thejudge professionalization and strive for the realization of judicial justice.
