The Study On Mechanism Of Interests Expressing For Vulnerable Groups Nowadays In China

With the transformation of the society, our social relations have been great changed. The polarization of groups is being intensified unceasingly, presenting the multiple interests main body. The vulnerable groups are inferior to others in the possession of the social resource. Vulnerable groups exist in any society, scholars generally divided them into physiological vulnerable groups and social vulnerable groups. This paper is focused on the social vulnerable groups in our country, this kind of vulnerable groups including the laid-off workers, migrant workers and farmers, its uniqueness is that their weak position could be changed by social structure adjustment.All walks of society stratums are divided constantly, and the unbalance between the poor and rich is gradually widened. Consequently, how to establish an effective mechanism to express the interests of the vulnerable groups in order to balance the interests of different groups and resolve social conflicts has become a practical issue concerning. This papered at the18th Party Congress Report:we should correctly handle problems among the people, and put in place a sound mechanism in which the Party and the government play the leading role in upholding the rights and interests of the people. We should maintain regular and open channels for the people to voice their demands, for coordinating their interests and for protecting their rights and interests.In this paper, by analyzing the social stratification theory, social conflict theory and the theory of human rights, illustrate the importance of improving the interests expressing mechanism of vulnerable groups in China. Based on the previous analysis, this paper discusses the shortcomings of interests expressing mechanism and the countermeasures. From the perspectives of vulnerable groups themselves, governmental level, institutional level and social level. On the vulnerable groups level, they need to enhance the expressing ability and economic strength. On institutional level, the administration need to improve the expressing channels of representative system, judicial system and the petition system. On governmental level, the government should change its concept of vulnerable groups’interests expressing and establish its role as mediator. On social level, we need to cultivate civil society and establish the social organizations.Interests implementation mechanism is also very important. In order to achieve the consistency of the paper structure, the author did not make up a chapter to discuss the mechanism of interests implementation, and it is discussed in the fifth chapter. The government is the main body to success vulnerable groups’demands. Therefore, the author added a part of improving the responses to protect the interests of vulnerable groups in the fifth chapter. Measures include:improving the evaluating system, institutional reforming, functions standardized, enhancing efficiency.The right is the most effective way to protect the interests of vulnerable groups, the fundamental reason why the interests of vulnerable groups are infringed is that their rights are not protected, and they got into a cycle of’lack of rights--lack of benefit--lack of rights’. The innovation of this article emphasized the importance of expressing rights and regard it as a key method to protect their rights and to solve the problem. At the same time, the paper also has some shortcomings. The mechanism of interests expressing is a multi-disciplinary subject, involving politics, social security and some knowledge of law. The author lacks the knowledge of social security and legal, so the article is incomplete and lack of the illustration. In addition, the data used in this paper is adequate and need further improvement.
