Research On The Construction Of ASEAN Community And The Development Tendency Of Its Relations With China

In2003,the ASEAN members agreed and promulgated Declaration of ASEAN Concord Ⅱ In this declaration.ASEAN first proposed the strategic objective of establishing ASEAN Community.The ASEAN Community consisted of three pillars of ASEAN Political Security Community,ASEAN Economic Community and ASEAN Socio-cultural Community.Up to now,it has been ten years since the implement of the strategy of establishing ASEAN Community.In the past ten years, ASEAN,on the basis of the Twelve Basic Documents issued by the past, continuously issued a series of legal and policy documents to promote its community construction,so that to form a set of independent legal system—ASEAN Law.Among them.the promulgation of ASEAN Charter provided a constitutional legal protection for the establishment of ASEAN’s nature and its policy-making principle and the like,and further improved ASEAN internal organization structure.The legal documents like ASEAN Economic Community Blueprint,ASEAN Political Security Community,ASEAN Socio-cultural Community and Master Plan on ASEAN Community indicated a general development direction for each of its pillar, formulated special strategical plan and action policy for its implement.In addition,ASEAN also regularly hold meetings.such as ASEAN Summit and ASEAN Ministerial Meetings.to constantly adjust or formulate its internal and external legislations and policies for making sure each action plan implemented in ASEAN.Now each pillar’s construction status of ASEAN Community is favorable in general.Especially the current situation of ASEAN Economic Community construction is optimistic.However, whether the ASEAN Community’s proposes can be achieved by the end of2015still remains to be seen.Because there are still many problems faced by ASEAN Community construction,which are difficult to be solved within a short time.such as historical problems,class polarization caused from ethnic complexity and religious culture’s diversity and so on.Both of proposing to construct ASEAN Community and putting it into effect are based on International Law and International Organization Law.Meanwhile,its internal activities’holding and progress need to be adjusted and guaranteed by International Law and International Organization Law.The practice of ASEAN Community construction has proved that ASEAN is able to take good advantage of International Law to solve such problems arisen during its progress.The legislations and laws issued during the process of ASEAN Community construction promoted International Law’s improvement and development,The issue and implement of ASEAN Human Rights Declaration is an example illustration.Meanwhile,ASEAN Community construction further improved the relations between ASEAN and neighboring countries,especially the relation with China.Firstly,ASEAN Community construction accelerated the constructive progress of CAFTA.Both sides have made significant achievements in Trade in Goods,Trade in Service and investment,for example,the cooperation conducted by both sides on the field of agriculture,information industry,energy sources,investment,cultural industry,tourism, public health area and environmental protection and the like are under good condition to this day.Secondly,China-ASEAN’s political cooperation mechanisms have been improving constantly. On the basic of cooperation mechanisms like China-ASEAN10+1,ASEAN plus three and ASEAN Summit,China and ASEAN have developed both sides’ political mutual trust and promoted good neighborly and friendly relations so that China-ASEAN relations could get a further consolidation.However,with the advance of CAFTA construction and ASEAN Community construction,China-ASEAN relations assume three kinds of development tendency,namely putting the "2+7" cooperation framework into effect,strengthening the board trade cooperation between China and ASEAN and expanding cooperation field under the CAFTA mechanism.China has to hold these three kinds of development tendency to deepen the relations with ASEAN,in order to promote CAFTA’s upgrade and maintain regional peace and stability.
