Housing is the basic element of human’s life which contains social and economic attributions. As for its social aspect, housing reflects the interpersonal relations or the relations between two or more autarkical individuals in the fields of production, allocation, exchange and disposition of housing resource. As far as its economic aspect, housing has become a sort of merchandise in the market-oriented economy. Its amount, price, allocation and policy are impacted by the supply and demand of market. Through macroscopic aspect, global economy condition has influence over the housing market in China; personal income, through microscopic aspect, has influence directly over the allocation of housing resource; while the level of housing obtained indicates the separation in social status. Thus implementing the low-rent housing system has become a significant social security all over the world to collapse the gap of wealth and to maintain social stability. In China, this implementation is feasible and imperative that was pointed out by the current situation and direction of development of social economy. China started late on the field of low-rent housing system and this is under the experiment. In July1998, the State Council of China stated the concept of low-rent housing by the first time through the "Notification about further deepening reform of the urban housing system and accelerating the housing construction" and officially classified the low-rent housing system into multilevel housing supplied system of urban. In April22,1999, the Ministry of Construction released the "Management approach of urban low-rent housing" after summarized the experience from pi lot regions like Shanghai, etc. This measure contributed much more detail to management system, target population, implementation mechanism and scope of liability, etc, of low-rent housing system. Hence it became the guidance which had built the foundation of low-rent housing system. In order to propel the serviceability of low-rent housing system throughout China, the "Management approach of urban low-rent housing for the lowest income families" was released by the Ministry of Construction cooperating with Ministry of Finance, Ministry of Civil Affairs, Ministry of Land and Resources and State Administration of Taxation and had been put into implementation on March1,2004where the "Management approach of urban low-rent housing" released on April22,1999had been substituted. By that time, the initial framework of low-rent housing system of China had been formed.This study engaged in analyzing, based on legal methods, those problems occurred from low-rent housing system and herein came up with a few opinions. This paper started from analyzing the concepts of low-rent housing and low-rent housing system and arrived at the significance of low-rent housing towards social development which was worked out from the aspects of features, legal basis. Next, a brief introduction presented the rather impeccable policies of low-rent housing system in countries outer China and the guarantee policy of low-rent housing in Hong Kong. The accomplished cases in these regions will be taken as reference to benefit the system in China. Here the issues that occurred while the low-rent housing system was under operation in China were analyzed. Eventually this paper presented that constructing the low-rent housing system in China, based on legal institutions, had its positive side over the right to adequate housing for lowest income families and over the improvement of low-rent housing system.
