The Study On Law About Low-rent Housing Policy’s Implementation

Right of habitation is the basic human rights of survival. It should be respected and protected. In big cities, the housing problem is particularly acute. Because urban population is complicated, people from all over the country and the world gathered here. Large Numbers of migrants come to cities which make the city unable to digest such large housing needs. Especially the disadvantaged group cannot rely on their own economical causes to buy or rent house in the market. So the phenomenon such as homelessness, group-oriented leasing or tramps was generated. Expensive cost of city life poses a great pressure to low-income groups. And inevitably, the heavy life burden produces negative emotions which affect social stability. But thankfully, governments have been aware of this problem. They establish the housing guarantee system, actively intervene in the market and adjust the social contradictions to help the disadvantaged group and ensure the basic right of the people. Among all of policy, the low-rent housing policy is the one which is the bottom in housing guarantees system and protects the low-income people’s right of habitation, playing an irreplaceable important role.In recent years, our country focus on promoting housing commercialization, but this does not mean that the role of government in solving the housing problem is weakened. On the contrary, due to the particularity of the housing problem and limitation of the market, the government should constantly strengthen the management of housing development, construction and distribution seriously, especially in city’s housing allocation issue. On the basis of making the market play a greater role, we will also further improve the housing guarantees system, in order to solve market failure on low and middle income families’housing problem. At present, Beijing, Shanghai and Guangzhou as the first metropolis in China, have faced with the stress of housing problem. Shanghai was the first city to carry out the low-rent housing policy all over the country which presents the front-ended model.It should be a typical research subject. The purpose of this study is to compare low-rent housing policy at home with abroad so that we can draw lessons from the successful experiences. Taking Shanghai as the model and on the basis of actual situation and the existing problems, this study will try to give some suggestions. Hope these suggestions can have a positive effect on the low-rent housing policy in Shanghai.This article is divided into six chapters. The first chapter introduced the research significance, research status at home and abroad, research methods, etc, setting the full text of the tone. The second chapter explained the basic theory of low-rent housing policy from the aspects of the constitution, administrative law and social law. Outline the low-rent housing system of legal basis and also summarize China’s general structure of housing guarantees system at present as well as the definition and function of low-rent housing policy in our country. The third chapter, according to the implementation situation of low-rent housing policy in Shanghai and the difficulties in the process, the author raised relative questions. The fourth chapter, the author summarized the more mature low-rent housing system from Germany, Netherlands and United States to provide reference for Shanghai low-rent housing system development. The fifth chapter is basic on the previous chapter which anal sizes and summarizes the foreign experience of city low-rent housing system. In the last chapter, the author synthesizes the whole text in combination with the practical situation in Shanghai. Aimed to the questions raised before, give some advices on low-rent housing in legal field to improve the system.
