With economic development, the car gradually become an indispensable tool in people’s lives, impact more and more on our lives.4S business model introduced in China has more than ten years, with the development of the automobile industry, car manufacturers widely established sales network.The4S model also produced a series of problems caused widespread concern, the most significant problem is the vertical restraints of competition. Countries in the world through the improvement of legislation to regulate the behavior of vertical restraints of competition, This article is from the theoretical and combined with4S business model, we found limitations which exist in competition, then learn from Western countries, especially the EU experience, come to our existence,in terms of legislation restricting competition phenomenon proposed regulation proposals.The first part of this article is an introduction to our4S business model including the development and introduction of the4S model, as well as the positive role it played,and which exist in order to better explore the longitudinal question of monopoly agreements.The second part of this article, the first exposition of vertical monopoly agreements, including its concept, characteristics and classification, followed by the vertical monopoly agreements economics finds controversy, finally, the4S model has monopoly agreements specific manifestations.The third part of this paper is to analyze the foreign regulatory model introduced the American model and the European Union model, because of the status tend to EU. The EU has a dedicated automotive sector regulation ordinance vertical monopoly agreements, this section focuses on the EU’s mode, and also expounded China can learn from the experience.The fourth part of this article, is a portrait of regulatory proposals to restrict competition, in particular on the anti-monopoly on the vertical restraints of competition provisions and the relevant provisions of the "Automotive Brand Management Implementation Measures " were analyzed, and draws the third part of some of the provisions of the EU, the problems of legal elaborate and the corresponding regulatory proposals. I hope we can face the vertical monopoly agreements regulation by the parties, to create a fair competitive environment.
