Ebony, known as the panda of the plant kingdom, is a non-renewable resource with high economic values, cultural values, historical and medical values as well as scientific research values.Ebony dispute is a new issue. In recent years, more and more ebony disputes have come into people’s vision, triggering a fierce discussion in the public. Experts and scholars in various fields share different opinions on the issue of ebony’s attribution,belonging to the state, to the owner of the land or to the citizen who finds the ebony. The goverment departmens are critized for competing interests with citizens. Throught the country, the methods of handling ebony disputes are different.With the development of economy, more and more resources will be find just like the ebony. Existing concepts could not summarize the substance, so this paper gives it a name, non-fossil precious plant relic. Ebony is the typical representative of the substance. A thorough analysis of ebony’s attribution and protection can make a contribution to the research of non-fossil precious plant relic.The standpoint of this paper is to provid the best protection for ebony. After the analysis of the relevant laws and regulations, concepts and theories, it makes a conclusion that the state, the owner of the land and the citizen who find ebony should share the benefits. They are the the co-owners by shares. The co-ownership is an effective way to resolve the disspute. The paper recommends to formulate and complete laws and regulations, to make a further study of theory. Making a reference to the cultural relics protection law and the regulation on the protection of fossils, local goverment could stipulate regulations. Enact instructive cases and guidelines for Administration and justice.
