| In recent years, with the development of rural land system, the expansion of urbanization and urban-rural integration progresses, more and more of the rural population into towns, the rural land circulation is increasingly active. Moreover, the rural economic development puts forward a higher requirement on the scale of operations and the agricultural modernization, the method of the land circulation has became more diversified."Contract after rent" is a kind of typical pattern in the development process in which the local governments, the villagers’ committees, farmers and other companies have participate in, so that the land circulation process is even more complicated and more related problems have arisen.This paper attempts to analyze the problems of rural land circulation problems in the perspective of the relationship between the government, the rural collective and farmers, then analyze the causes and propose appropriate countermeasures. The process of this paper is asking questions, analyzing and solving problems. The first part analyzes the status situation by "Contract after rent", and proposes a class of typical problems which is the complex relationship between the government, the collective and farmers. The second part analyzes the causes of the problem. The primary cause is the imperfect legal system of land circulation, then the roles orientation of the local government and the villagers’ committees are not clear. In addition, the limitations of the rural social situation should not be ignored.Therefore, the corresponding countermeasures and suggestions have been put forward in the third part. Firstly, it should improve legislation, secondly the participating subjects should clear the rights and functions of the operating mechanism.Then farmers, the collective and the government should strengthen communication and coordination.Finally, it should improve the judicial remedies, fully protecting the legal rights of farmers. |
