Food is the basic demand for survival and the use of land resources greatly affects farmers’ living standards and security. The transfer of land contract and management rights impact the use of land resources, therefore, research on land contracting right has been put on the agenda. The effective management of rural land contract is not only a requirement for the building of a new socialist countryside, but also an important part of the overall well-off society. However, China’s social security system does not cover all of the rural areas, so once land transfer goes wrong, farmers’ rights and interests will not be guaranteed. Since the reform and opening up, the household contract responsibility system has been implemented in rural areas, which revolutionized the sluggish land ownership system under the planned economic system. Compared with the past "collective ownership", today’s dual land management system has largely relieved the constraints on the land transfer process and helped the circulation of rural land contract and management rights. But there are still many problems in the legislation and ways of land circulation. The government should regulate the market system, improve the relevant registration systems, put forward reasonable and effective proposals, make sure who the main body is in land contracting and circulation, protect the farmers’ interests and establish standardized service agencies, thus resolving the contradictions between the functions of social security and land transfer to further improve the land contracting and resumption system.Therefore, the establishment of a scientific and effective rural land contract management rights transfer system is crucial to solving the existing problems concerning land. Rationalizing land contract management rights transfer of rural is the need of the reality, which not only safeguards the economic interests of the farmers on the land, but also optimizes the allocation of land resources. The combination of land and farmers’ interests will maximize the comprehensive benefits of farmland. In the process of land contract management rights transfer, conflicts between public interests, individual interests and collective interests may appear. Coordinated efforts are needed to take into consideration the interests of all the parties concerned and thus further promote the rural economy development and successful implementation of land management to ensure lasting stability of rural society and harmonious development.
