Villager’s autonomy rights, as the core of the villager autonomysystem, is the guarantee of villagers exercising autonomy in autonomousmanagement of village affairs to maximize the implementation. Thecorrect understanding and guarantee the villagers’ autonomy rights for thepromotion of villagers autonomy system implementation and improve thesystem of democracy has the vital significance. From the perspective ofthe legal system of our country at present, the related law of the villagers’autonomy rights is not clearly, we can’t give the villager’s autonomyrights by given enough legal guarantee when it suffers destroy. From theperspective of the rule of law process, through the villagers’ autonomy inthe practice more than30years, the phenomenon of infringement of thevillager’s autonomy right always happened, such astownship-government interference in the villagers autonomous affairs, thevillage committee members interference in the villager’s democraticrights, villagers’ land and collective economic organization interests areviolated, and so on. As the change and the demand of the new era, thecontinuous development of modern democracy and rule of law society,the villager’s autonomy rights need to get proper judicial protectionurgently, the proper judicial protection also is the fundamental guaranteeof the villager’s autonomy rights. On this basis, the author via theanalysis of the villager’s autonomy right to build ideas on it inadministrative litigation protection preliminarily in the future.In this paper, the first chapter, the basic principle of villager’s autonomy and villager’s autonomy rights. The author start from twoaspects of " the meaning of villager’s autonomy " and "the analysis of thevillager’s autonomy rights" to analyzed " villager’s autonomy" and "thevillager’s autonomy rights" in detail, and the difference between thevillagers’ autonomy rights and other autonomy right for the simple andclear instructions.
