Research On The Villager’s Voting Right

Villager’s self-government in china has been implemented for nearly three decades. Villager’s self_-government is one kind of grassroots’democracy. Article111of the Constitution of the People’s Republic clearly stipulates that villager’s committee is the grassroots mass organization of self-government.Villager’s voting right is the most important right of villager’s self-government, is also the foundation of villager’s self-government.The paper is based on the theory of villager’s voting right and by means of logic and dialectical analysis,the misconduct which offends the villager’s voting right were summarized consisting of several aspects:bribery at election、illegal interference with the villagers committee elections by the township government and its staff、familiarization,etc. There are many kinds of illegal activities at the villagers committee elections, because of irrationality in villagers committee elections system、lack of laws and regulations、interest driving in villagers committee elections. At present,legal relief mechanisms for villager s’right to elect need to be established and perfected, because of the limitation of internal legal relief mechanisms for the villagers’right to elect、 unsatisfactory effect of administrative relief、lack of procedural relief.In order to protect the villager’s voting right,we should perfect the legal relief mechanisms for villagers’right to elect. Firstly, we should introduce a law of the villagers committee election in the whole country. Secondly, we should establish and perfect the procedural relief for villager’s voting right. Thirdly, we should perfect the administrative relief for villager’s voting right.Villager’s voting right is an important legal right for villagers. Villager’s voting right is also an important right of Villager’s self-government. We should strengthen the legislative safeguard of villager’s voting right, establish and perfect the legal relief mechanisms for villagers’ right to elect, well protect villager’s voting right.
