Comparison And Study For Laws Of China And America On Water And Soil Conservation

China, one of the countries with the most serious problem of water and soil loss, now issuffering for a series of problem such as land degradation and ecological deterioration. Thus,completing the law of water and soil conservation becomes a critical task. America once wasthe country with serious problem of water and soil loss, and now is developed on the law ofwater and soil conservation. In order to improve the development of its theory and thecompleting of current regulations, it is necessary to compare and study the laws of the PRCand the USA on water and soil conservation.This thesis is based on the environmental protection law and related theories of water and soilconservation, adopts study methods of comparative analysis, literature research, empiricalanalysis and historical analysis to compare and analyze the four issues: the development ofwater and soil conservation laws and regulations, organization setting up principles for waterand soil conservation, water and soil conservation measures and its publicity andinstruction.After analysis, it is shows that the development of American laws leads a stablelaw system and builds a concept of people-oriented in water and soil conservation. While, inChina, the target for water and soil conservation is to guarantee the developing of economyand society, and the theory of people-oriented is relatively weak. Therefore, we need tochange the target of legislation so as to perfect Chinese laws on water and soil conservation,by studying American laws.The setting up of water and soil conservation organization inAmerica is systematic and complete, and there are many professional persons. However, dueto the special legislation mode, in China, the functions of organizations for water and soilconservation are complicated and overlapping heavily. Inspired by American water and soilorganization system, some improvement may be implemented in China combined with theChinese situation.The measures for water and soil conservation in America, which arepractical, drive the land owners protecting their resources positively. But in China, thegovernment is conservative on measures setting up. It shall learn the people-oriented theoryon water and soil conservation of America and improve the setting up and implement ofmeasures. The publicity and instruction for water and soil conservation in America arepractical and will drive the positivity of the public to conserve water and soil. While in China, it is simple and unpractical. To complete the publicity and instruction of water and soilconservation, the basis is to strengthen the public sense.
