Research On Public Network Participation In The Formation Of Government Regulations

At present, with the accelerating process of democracy, public enthusiasm for the management of the state and society keeps rising, and with the rapid development of network technology, the quite developed network media, the convenient and rapid network mode, public network participation is more and more active. The public participate in the making of government regulations through many network modes, achieved good results. But due to the lack of the research of public network participation in the formation of regulations, there are many problems that should be solved urgently in practice. Therefore, we should construct the legal norms of unified standards of public network participation, and improve the construction of the relevant systems and mechanisms immediately.This thesis starts with the study on conception. What is the public network participation in the government regulations? Through analytical reasoning, the author believes it refers to the public take part in each link of government regulations and express their opinion and proposal through network in a particular way, so that with their participation, the administrative organ will response and have a material effect on the results. This concept mainly emphasizes the comprehensiveness、 communication and substantiality of participation. Public participation has broad theoretical basis, which provides source material and nutrient for the development of public participation. Nowadays, there are a variety of forms of practice for public network participation in the formation of government regulations, and made great progress. But due to the lag of idea of public participation, unsound system and mechanism, incomplete supporting laws and regulations, and not strong public participation ability, public network participation in the formation of regulations is restricted. Compared with the mature system of some developed countries such as UK, US etc. the shortfalls are just as big. Given we know the differences between china and developed countries are great, the author puts forward the concrete countermeasures of public network participation in the formation of government regulations, and tries to give the construction way in practical work.
