Research On Public Participation In Local Decrees In China

The local regulations are an important part of the national legal system,and play an important role in the construction of the national legal system.The public participation in the local legislation is an important way to implement the provisions of the relevant policies and to implement the regulations of the constitution of our country and to ensure the people are masters of the country.In 2014,the report about some major issues concerning comprehensively implementing governing the country by law attach great importance to deepening scientific legislation and democratic legislation.In 2015,the fifth article of the revised legislative law stipulates the principles of democratic legislation,which requires the protection of the people to participate in the legislative activities through a variety of ways.In 2017,the report of the 19 th National Congress of the Communist Party of China also pointed out that we should improve the system of the people's ownership and the development of socialist democracy.The discussion on public participation in legislation has been going on for a long time,however,at present,the research on the legislation mechanism of public participation in local regulations is not enough.The thesis narrows the scope of local legislation,only analyzes and discusses from the local legislation in narrow sense,namely only refers to the legislative law of local people's congress and its standing committee in accordance with the constitution and the law,according to certain procedures,approval,amendment and repeal of local regulations,in order to be more specific and more targeted.This thesis mainly uses the method of normative analysis,analysis of social analysis combined with empirical research on the mechanism of public participation in local legislation in China,involving basic concepts and basic theory,the current situation of our country,and put forward the path.It plays an important role in the socialist democracy and the rule of law theory.Besides,it is of great significance to promote the process of socialist democracy and the rule of law.In our country,our citizens' participation in local legislation and legislation has been greatly developed,however,it is still in the initial stage of development.With the rapid development of information technology,"Internet plus" technology meet the needs of the times,and provide an effective guarantee for the realization of democracy in legislation and the citizens' orderly participation in legislation.We should make everyeffort to further improve our public participation in local regulation mechanism.On the one hand,we are supposed to improve the relevant legal system.In addition,the legislature shall formulate normalizative document of law of public participation in local legislation,and provide legal support for public participation,also provide comprehensive guidance for the behavior of the public participation.On the other hand,in practice,we should explore the new mode of "Internet plus public participation in local legislation ",to protect the public have the right to participate in legislation through a variety of ways and to fulfill its utmost value.
