House prices has become one of the people’s most concerned social issues incurrent in our country.High prices caused the excessive expansion of the real estatemarket,which affects the whole development of our economy and the overall stabilityof the society.In order to regulate the real estate market,and to guarantee the smoothdevelopment of the real estate market, the state has staged a series of regulation andcontrol policy.Intensive regulation policy, however, failed to bring positive change,the real estate market instead of the rise in house prices in several major cities spreadto the country, rising house prices continue not falling.Which enough to account forthe national regulation is exciting some problems.Author of this paper begin study onit.First is to understand China’s real estate market regulation policy, again in recentyears, the regulation and control policy for the typical in-depth interpretation,whichaccount for a comprehensive understanding of China’s real estate market regulationeffect.Second is from the legal Angle analysis of existing problems of the real estatemarket regulation policy in China, including policy own defects, the illegal and policyobstacles in the execution.Finally according to the proposed problem to give legaladvice.First, the coordination of policy and law, the author thinks that the law shouldbe as the main specification of regulating the real estate market, supplemented bypolicy regulation; second, we should use the concept of economic law to perfect thepolicy itself, pay attention to the appropriate intervention and fair.Third, we shouldimprove the execution of the policy, first of all, the interests of the parties mustcoordinate market main body, secondly by strengthening the legal construction ofaffordable housing to assist in the supervision of control.
