Research On Major Administrative Decision-hearing System

Along with the promotion of the rule of law and the evolving concept of administrativedecision-making process of national law, the scope of application of the hearing system continuesto expand. From the initial applied only to the specific administrative act, extended to apply toadministrative decisions in the field, including the development of major administrative hearingsystem in decision-making is particularly the introduction of concern. China has not yet issuedAdministrative Procedure Code, the relevant provisions of the significant administrative hearingsystem more sporadically seen in a single line of laws, rules and regulations, but this did notaffectthe function of the positioning system designers and the public conferred by this system.In practice, however, a major administrative hearing system is in an awkward position, on theone hand is positioned highly functional, the other is the implementation of low citizensatisfaction. How to change this dilemma, to bridge the significant administrative hearing systemideal location and features a huge gap between the reality of the efficacy of the current problemsto be solved.This paper is divided into six chapters. From the existing normative documents on majoradministrative hearing system, combining with practices, analyzed the current issues of majoradministrative hearing system existing, and put forward the proposal for improvement.I n order tobridge the the gap between the ideal function of major administrative hearing system and thereality efficacy helpful.The first chapter is introduction, expounds the research background and significance,research methods and the difficulties existing in the research, lay the foundation for later writing.The second chapter is overview on major administrative hearing system. The main contentsare: defining relevant concepts and discrimination, to make a clear that the link and thedifference between hearing and major administrative decisions of the general administrative hearing; describing the theoretical basis of the hearing system applied in the field of majoradministrative decisions; expliciting function of major administrative hearing system positioning.The third chapter is related to text analysis hearing system on the major administrativedecisions. From about the major administrative decision hearing system of our country’s existingnormative documents, dividing the process of administrative decision-making hearings for theinstitutional basis of the hearing, the hearing started, the participation of the hearing, and hearingthe aftermath of four stages, the entire program decomposition of the hearing system, applicationsystem analysis of the major administrative decision-making hearings.The fourth chapter analyzes existing problems on the major administrative hearing systemcombined with the last chapter content. Mainly in three aspects: the absence of relevant legaldocuments, and the lack of appropriate supervision and safeguards on implementation of thesystem, the missing of corresponding existing specifications for the system.The fifth chapter elaboraes suggestions of perfecting our country’s major administrativedecision hearing system. Finding the problem is a prerequisite and solving problems is the key.This chapter targets recommendations for improvement of the problems which mentioned on lastchapter. The main methods are: the development of specialized laws to protect hearing systemimplementation; establish a sound mechanism for monitoring and protection of the hearing system;enhance the quality of legislation and improve relevant systems and regulations.The sixth chapter is a conclusion which outlooks major administrative decisions’ directionon hearing system.
