Recently, with the process of China’s Democratization speeding up, the civil democratic awareness has been advancing, and they have become active participators in the major administrative decision-making, which is the remarkable progress achieved in the process of ruling our country by law. However, in the course of forming these major administrative decisions, administrative organs usually infringe the civil legitimate rights while enforcing their decision-making right. To avoid this infringement, it is imperative to implement the administrative hearing system in the major administrative decision-making. The administrative hearing system is of great significance not only in improving the scientific nature and democracy of the major administrative decisions, but also in ensuring the effectiveness and feasibility of them. The administrative hearing system is one of the effective measures to guarantee the scientific nature of the major administrative decisions and to safeguard and fulfill the civil right to participate, to oversee and to know as well. This essay mainly focuses on how to enhance the public trust and executive force in the major administrative decision-making. Despite the fact that the administrative hearing system has been fully applied in administrative procedures and has given certain play to the civil democratic supervision roles, there are still imperfections in the current administrative hearing system. This essay, first of all, on the basis of the problems existing in the current administrative hearing system, starts from the concept of the major administrative decision-making to state the essential meaning of it and analyze the differences between the administrative hearing system and other ordinary ones. And then it analyzes the origins of the major administrative decision-making and discusses the theoretical basis of the hearing. Finally, from China’s actual situation, it describes the current situation of the scope of the administrative hearing, its procedures and its main body and gives further analysis on the drawbacks and their causes existing in implementation of the administrative hearing. On the basis of the analyses above, the essay recommends appropriate solutions to the improvement of the current administrative hearing. It also puts forward a series of constructive suggestions by the means of using various advanced foreign administrative hearing systems for reference in the hope of promoting the development of the administrative hearing system in China.
