Criminal Justice Under The Background Of Network Media

Nowadays, with the rapid development of news media, the impact of network publicopinion on justice is deepening and producing not only positive effects but also somenegative effects inevitably. We have to realize that to criminal justice, the public opinionfrom network acts as the role of a double-edged sword: from the positive side, the publicopinion from network is helpful to promote judicial openness and impartiality, however,from the negative side, some aggressive public opinion about the judgment has hurtjudicial justice. Under the new situation, the relationship between network public opinionand criminal justice, along with how to build a positive-interacting mechanism betweennetwork supervision and criminal justice has been urgent issues.This article is divided into four parts, the first part summarizes the development ofpublic opinion and the characteristics of network public opinion, and analyze thedifferences of traditional and network public opinion’s supervising the criminal justice.The second part analyses the relationship between network public opinion andcriminal justice from the necessity of supervision and present situation, and it points outthe positive and negative effect of the network public opinion on the independence of thecriminal justice, the rights of the parties, and the judicial procedure of criminal justice.The third part analyses the reason of the conflicts between network public opinionand criminal justice and it further points out that although there is a conflict, but also theexistence of co-exist.The fourth part puts forward a solution to the conflict of network public opinion andcriminal justice, it starts with establishing an independent judicial action mechanism andbuilding the network public opinion supervision system which respects the criminal judicial characteristic, and it coordinates their good interaction.The method used in this study are: case analysis, comparative analysis and literatureanalysis method.
