Since its inclusion in the GATT,countervailing measure has been developed into a significant non-tariff trade measure used by many countries to prevent or stop subsidies and to protect domestic industry. After the completion of Uruguay Round and the establishment of the WTO,many developed counties began to amend and revise their anti-subsidy laws,meanwhile many developing counties began to adopt anti-subsidy legislation and jurisdiction. China's anti-subsidy legislation and jurisdiction is just started,but it is far from perfection,it is significant for china to stressing the study of anti-subsidy law system by drawing on the experience of western legislation in order to perfect the china's anti-subsidy legislation and complied with the WTO. And this is the purpose of this paper too.First,this paper makes a summary of related theories on subsidy and anti-subsidy law. And makes suggestion on Chinese strategy to the new subsidy agreement too. Then,this paper makes a comparative study on the substantive and procedural provisions of the anti-subsidy laws of western counties.Finally,this article puts forward a number of legistive proposals by drawing on the experience of western legislation combined with China's unique situation. Aiming at fairness,objectiveness and transparency,the author hope such viewpoints could be benefit for perfection of china's anti-subsidy legislation.
