Study On The Protection Of Peasants’ Environmental Rights

The right for environment is a kind of new right which had been recognized bypeople, after the global environmental crisis. Many countries had been recognized thatcitizens have the right for environment. Today, more and more attention are paid onenvironmental issues，China’s environmental problems are still serious and are gettingworse and worse. Urban economic achievements have attracted worldwide attentions,while the serious pollution which caused by the resource consumption are beingmoved to rural areas. Now rural environment is suffering more serious damage thanurban environment: pollution from rural areas and pollution from urban areas.Pressures caused by the double pollution result in more damage to the ruralenvironment, so the protection of peasants’ right for environment is seriously difficult.In the process of constructing legal society of equity, justice, equality and harmonious,protecting peasants’ right for environment is meaningful for maintainingenvironmental equity, protecting peasants’ survival and development rights andprotecting of basic human rights.Overall, rural citizens face a more pressing economic development pressure.While in our urban-rural dual model, rural citizens enjoy less development intereststhan urban citizens, while rural citizens carry greater burden in the economicdevelopment. The inefficient protection of right for environmental threatens thesurvival and development rights of rural citizens directly. Therefore, the right forenvironmental of rural citizens is at an even greater disadvantage position than urbancitizens.On the basis of studying on the origin, concept, nature, content of the right forenvironment, this paper prescribes the concept of peasants’ right for environment. Onthe basis of analyzing the reasons for the protection of peasants’ right for environmentlack of vigorous measures,I want to apply both legal method and political theory ofgood governance to the protection of peasants’ right for environment and put forwardthe constructive proposals to the protection of peasants’ right for environment. Finally,this paper proposes three advises to the protection of peasants’ right for environment:First, confirms the peasants’ right for environment in Constitution and the law and places rural citizens in the dominant position of rural environmental management inorder to establish the village environmental management system. Second, builds up thelegal system to protect the rural environment. Third, rationalizes the ways of protectionof the peasants’ right for environment. Under the direction of “Good governance”, thepaper uses the political, social and legal methods to governance rural environment inorder to protect the peasants’ right for environment effectively.
