The Identification Of Trade Secrets In Cloud Environment

With the emergence of cloud computing, more and more people begin topay attention the safety of trade secrets. The purpose of this paper is to studythe characteristics and the impacts on the elements of trade secrets in cloudenvironment.After analyzing the characteristics of cloud computing. We conclude thatthe trade secrets have new features such as separation of management rightsand ownership, location global, dispersion, carrier sharing, and mobility incloud environment. We also believed that there are impacts on the tradesecrets elements of secrecy and manageability in cloud environment. There isno special provision for cloud service providers’ legal obligation ofconfidentiality. And the service level agreement may become nominal. Itmakes the trade secrets risk losing secrecy. The security measure is differentbetween each cloud service provider. We can’t distinguish the level of“reasonable security measure”, which makes the trade secrets risk losingconfidentiality.We recommended that take measures on the standardization of securitymeasure, market access, market regulatory and confidentiality regulatory.
