A Comparative Study On Trade Secret Protection In The Cloud Environment

Trade secrets protection is originated and widely applied in the contextof traditional environment. With the rapid development of internet, tradesecrets protection has not only been limited in the context of traditionalenvironment. In particular, cloud computing is widely adopted in thecontemporary era, which make trade secrets protection more complicated.From the angle of trade secrets protection legislation in America, Japan andmany other countries and combined with the coping strategies among thosecountries, this paper first carries on a profound comparative study betweenthose countries and present situation of our country. Through the comparison,overseas advanced experience is summarized and shortages in Chineselegislation are put forward. Lastly, by analyzing the characteristics of tradesecrets protection in the cloud computing, this paper offers some personalopinions above trade secrets protection in our country. This study finds thatalthough trade secrets storage appears to have its own specialty in the cloud computing, it has not completely gotten ride of commercial trade in thecontext of traditional environment. Therefore, the author suggests: on the onehand, our country should adjust and improve the relevant laws andregulations to adept the rapid development of cloud computing; on the otherhand, in the absence of specific legislation, trade secrets protection in thecloudy computing context can be protected by relevant laws in thetraditional environment.
