Research On The Administrative Compensation System In Public Health Emergencies

This dissertation which was subdivided into three parts, proposed approaches forperfecting administrative compensation system by reviewing the status of currentsystem and comparing it with foreign administrative compensation systems.Chapter1is “the necessity and rationality of the compensation to the destroy made bypublic health emergencies”. The first part analysis the necessity by citing examples ofhuman casualties and property damages during the public health emergencies. Then itexplores basic theoriesChapter1Loss compensation system in Germany and Japan the experience ofother countries and regions are discussed and practices, and to summarize the practiceoutside of advanced. Then detailed analysis of the present administrativecompensation legislation present situation, and summarize my lack of legislation.Chapter12is divided into two parts, the first part is the necessity of analysis, withbird flu around the sequelae of SARS and facing to the closure of the live poultrymarkets, culling of live poultry effects caused by the necessity of damages; Thesecond part is analysis the rationality of the compensation and the sacrifice of specialtheory, fair theory, the responsibility theory and principles of human rights protection,the principle of property rights protection, the goal of socialist country under the ruleof law based on the rationality of the damages.Chapter3from the compensation principles, compensation standards,compensation, compensation procedures and supervision of the improvement of thesystem of public health emergencies loss compensation concrete Suggestions are putforward.
