| With the development of social economy, ecological tourism has become a pattern of tourism which conforms with the trend of social and economic development. Considering the unique geographical environment of Shaanxi Province, extremely rich ecological tourism resources, it is of great practical significance to build perfect ecotourism legal protection system so as to ease the contradiction between tourism development and ecological environment protection, and furthermore improve the quality of Shaanxi ecological environment, promote the development of social economy and culture, and build a harmonious society.In this paper, a comparative analysis is carried out to the legal protection system of Shaanxi ecotourism applying method of literature analysis, questionnaire and method of comparative analysis. Firstly, perception of domestic experts to the definition of ecological tourism is analyzed based on the statement of emergence of ecological tourism; Secondly, study is performed to the status of resource, legal protection and function of legal protection of ecological tourism in Shaanxi Province; Thirdly, bottle neck faced by ecological tourism of Shaanxi Province is analyzed from expects of legal conception, legal system and legal regulations; After that, study is given to advanced experience regarding legal protection of ecological tourism in the Unites States, Canada and Japan, meanwhile experiences which are referential to ecological tourism of Shaanxi Province is put forward, Finally, countermeasures on legal protection for ecological tourism in Shaanxi Province is worked out from the aspects of legal conception, legal system and legal regulations with consideration of actual status of ecological tourism in Shaanxi Province and reference to the successful experience abroad. This paper is innovative in that research is focused on ecological tourism of Shaanxi Province, and questions are all posed, analyzed and resolved standing at the point of ecological tourism in Shaanxi Province although references are given to relevant foreign knowledge. Furthermore, legal guarantee system for ecologic tourism of Shaanxi Province is established in this paper from the perspective of law to solve the problems of legal protection faced by ecological tourism in Shaanxi Province, and hope to be able to achieve harmony between ecological environment and social and economic development, so as to achieve the purpose and value of this research. |
