Research On The Film And Television Industry Policies And Regulations Reform In China Under WTO System

After our country joins WTO, the development of the film and television industry and international community has become more closely, fully study the provisions relating to cultural industries in WTO, especially the part about the conflict and coordination of trade policy and industrial policy content is crucial for solving this kind of problem, at the same time in Britain and the United States, France, South Korea, India and other representatives of the film and television industry the policy of national carries on the analysis comparison, understanding of different countries and the film and television policy achievements and shortcomings, and as a basis for analysis of China’s film and television industry policy, eventually under the framework of WTO to find the perfect law reform and development of the film and television industry in China, the maximum and promote the rapid development of the film and television industry in our country.Besides the introduction and the conclusion, this paper consists of four parts.The first part: Study on relationships with the film and television industry policies and regulations under WTO system. This part is divided into two sections. The first section is related to the film and television industry under WTO, including the basic introduction of the film and television industry as well as the relevant WTO principles and rules. The second section is the conflict and coordination of interactive correlation with the relevant WTO provisions and the film and television industry policies and regulations, based on the first interpretation of the general sense of trade policy and industrial policy, pointing out that the film and television industry policies and regulations need to comply with the WTO rules.The second part: Study on the five foreign countries’ film and television industry policies and regulations under the WTO system. This part is divided into two sections, hoping the analysis through the laws of these countries can be found in our country can learn from the place. Finding the features of different countries of the United States, France, Britain, South Korea and India’s domestic film and television industry policies and regulations and trade policies and regulations related to the WTO rules in the previous two sections. The third section is to analyze the coordination strategy between these national industrial policies and regulations, and wishing that we can find out the reference place for our country..The third part: The analysis of the present situation of film industry policies and regulations in China under WTO system. This part is divided into two sections, the first section is an overview of the film and television industry policies and regulations of our country, through the analysis of the two aspects of industrial policies and trade policies and regulations on the current china in the adjustment of the film and television industries with the important role of laws and regulations, also compared the before with the after of China’s accession to the WTO about the film industry policies and regulations. And then pointing out the existence problems of film industry policies and regulations in our country, Specifically including four aspects that film and television industry policy support needs to be promoted, import and export policy is not reasonable, widely existing quota system, domestic legislation system is not perfect etc.The fourth part: The suggestion for improvement of the film industry policies and regulations in China under WTO system. This part is divided into three sections, the first section is the international situation of the film and television industry in China, and analyzes the two aspects of the opportunities and challenges that China’s film and television industry is currently facing. The second section is the suggestion for improvement of the industry policies and regulations of the film and television industry in our country, which mainly need to strengthen the policy support and improve the domestic legislation. The former through increasing investment tax incentives, intellectual property protection and creative industries for the film and television industry to support; the latter is shown to by promulgated the film and television industry promotion law, with movie and TV series and ways to integrate the domestic film and television industry legislation, promote the sound development of China’s film and television industry. The third section is the suggestion for improvement of China’s film and television industry of trade policies and regulations, namely on the import side release film and television industry the right to import, in exports further stimulate exports, increase the export subsidies, gradually abolishing the quota system, through two methods of exchanging import quality quota for support and exchanging import time quota for support,and then gradually cancel the quota system.
